Former Special Counsel Robert Hur defended his report on his investigation into President Biden’s handling of classified documents in testimony Tuesday before the House Judiciary Committee. “My team and I conducted a thorough, independent investigation. We identified evidence that the president willfully retained classified materials after the end of his vice presidency, when he was a private citizen,” he said. “We did not, however, identify evidence that rose to the level of proof beyond a reasonable doubt. Because the evidence fell short of that standard, I declined to recommend criminal charges against Mr. Biden.” Republicans have seized on Mr. Hur’s characterization of President Biden’s mental acuity in the report, which calls him a “sympathetic, well-meaning elderly man with a poor memory,” one of the reasons Mr. Hur thought he would be unable to secure a conviction at trial. Democrats and the White House have criticized Mr. Hur for including that language in his report, taking particular issue with his assertion that President Biden did not remember when his son Beau died. “I don’t need anyone, anyone, to remind me when he passed away,” President Biden said in response after the report was published. “How the hell dare he raise that.” Mr. Hur testified that he was tasked with determining whether the president retained or disclosed national defense information “willfully,” meaning knowingly and with the intent to do something against the law. “For that reason, I had to consider the president’s memory and overall mental state, and how a jury likely would perceive his memory and mental state in a criminal trial,” he said. “And because these issues were important to my ultimate decision, I had to include a discussion of them in my report to the attorney general.” #specialcounsel #roberthur #joebiden #houseofrepresentatives #congress #cspan
